A power of attorney, often shortened to POA, is a legal document through which one person authorises another person to act on their behalf within defined limits.

In a Dubai property context, that representative may be asked to perform certain formal acts for the buyer or seller.

The authority comes from the wording of the POA.

If a power is not included, the representative should not be assumed to have it.

2. Dubai Land Department recognises legally authorised representatives

6. A POA issued outside the UAE needs additional formalisation

International buyers often prepare documents while they are still in their home country.

A POA created outside the UAE may need a formal ratification chain before Dubai Land Department will accept it.

DLD’s current guidance states that an overseas POA must be ratified through the relevant authorities in the country of origin, including the notary/public authority process and the UAE diplomatic channel, and then through the UAE Ministry of Foreign Affairs.

This is not a step to leave until the transaction date.

If the buyer expects to rely on a foreign-issued POA, the acceptance route should be confirmed early enough to complete the required legalisation.

7. Do not assume a POA prepared for one purpose works for another

A document prepared to manage a property is not automatically suitable for buying or selling it.

Likewise, a POA created for one specific transaction may not provide the powers required for another.

Before using an existing POA, check:

  • who granted it

  • who the representative is
